Notes About the Draft
- In final hearing we had in 2010, our bill had some amendments made that do not appear on the linked version above. The state only updates the language on its website if the bill passes out of the committee in which the amendments were made. Since our bill was tabled after being amended, and then not brought back off the table, the language that appears in the link above is the version of the language just prior to it being tabled.
- While this bill changed what we went for in the 2009 half of the session (that year's bill would have set up a mandatory License and set up our own board) to a voluntary "Registration" and an Advisory Council working under the organization of the Board of Nursing, the majority of the clauses remained in the bill. There was still a Local Pre-emption clause, a reciprocity clause (titled the "Registration by endorsement" clause,) and a very generous Grandfathering clause, all of which we are committed to including in future bills.
- This was what is called a Title Protection act. That means that only those with the state credential would be able to use the state protected title, in this case, "Registered Massage Therapist" or "RMT".
- Those who choose not to register with the state could go on practicing massage therapy and can advertise that they do massage or massage therapy.
- The only thing those non-registered massage therapists cannot do is say they are a "Registered Massage Therapist".
- This provides the protection to the public for which a state law is intended by providing potential clients with a pre-qualified pool of practitioners who have been vetted for education/experience, relevant criminal history, having current malpractice insurance, etc. The statute, and subsequent "rules" set up by the board also provide an efficient, enforceable set of standards as a way to make sure those credentialed practitioners who step out of bounds are held accountable.
